Pension Update - Recent Motions Ruling by Judge Marvin Garbis PDF Print E-mail

Last Friday, there was an article in The Sun describing a recent motions decision delivered by the Honorable Judge Marvin Garbis of the U.S. District Court for the District of Maryland.  As a result of that article, there has been a number of questions as to what happened and whether or not the FOP and Fire Unions "lost" the pension lawsuit.  The short answer to that question is "No". The legal fight is far from over and further, the FOP and Fire Unions have met with the Mayor and we remain hopeful we can resolve this issue through a negotiated settlement.  

Although the summary below is long and complex, we think it is important to provide our members with accurate information.  We only ask that our members not rely on street rumors, reports in The Sun, or comments from anyone not actually engaged in the fight on our side.

On Wednesday, December 5th from 8:30am - 5:00pm, a Pre-Retirement Seminar will be held at the FOP Hall. The seminar is hosted by the BPD/Personnel Section, Employee/Retiree Affiars Unit. The seminar will focus on retirement benefits and other issues directly related to the retirement process. A continental breakfast and light lunch will be served.

Police Commissioner Anthony Batts will be joining us at the November General Membership Meeting.  Please join us for the final meeting of the calendar year and listen to the newly appointed Baltimore Police Commissioner discuss his vision for our agency and the City of Baltimore.  Dinner will be served afterwards. The meeting will be held on Monday, November 26, 2012 at 7:00pm at the FOP Hall located at 3920 Buena Vista Avenue, Baltimore, 21211.

All FOP members and their families are reminded that today, Tuesday, November 6th, is Election Day and polls are open across the United States.  Be sure to get to your local polling place and support those candidates, Democrat, Republican, or Independent, who support law enforcement as well as any ballot initiatives. 

The National FOP has voted NOT to make any endorsement in this year's presidential contest between President Barack Obama and Governor Mitt Romney.

UPDATE 10/29/2012 at 1630 hrs:  Per the Office of the Labor Commissioner, the Mayor has issued an Executive Order shutting down City government tomorrow, Tuesday, 10/30/2012.  Effective midnight tonight, all essential government workers, to include Police Officers, who are working will be compensated at double their regular rate of pay.  This is in addition to any overtime pay and compensation pay for canceled leave.

The following is a synopsis of our overtime rates for the current deployment to cover Hurricane Sandy:

We are entitled to double our rate of pay when the Mayor shuts down City government but essential workers such as Police and Fire have to remain. This hasn't happened with Hurricane Sandy as of this date/time. Instead, the Mayor has allowed liberal leave for government workers except for essential workers. This policy is found in the City's Administrative Manual, not our contract.

Now, all our other overtime rates apply - so if you work more than your regularly scheduled tour in any given day, you are entitled to overtime. If you were on a V or H day and had it canceled and was called into work since the Police Commissioner declared an emergency and canceled all Leave, then you get 4 hours for the cancellation, plus the day back, plus whatever overtime you work later on that day - as you will be during these mandatory 12 hour shifts. All of this can be found in the contract on www.fop3.org under the header "Lodge 3".
