Pension Update - Third Trial / U.S. District Court Print E-mail

On Monday, January 30, 2012, at 10:00 a.m. before the Honorable Judge Marvin Garbis of the U.S. District Court for the District of Maryland, the FOP and IAFF Local 734, and our attorneys from Saul Ewing, will again argue our suit filed against the Mayor and City Council of Baltimore relative to Ordinance 10-306 (enacted in July 2010).

This phase of the trial (Third Trial) will allow the Court to address the final issue in our federal Contract Clause claim which will answer whether Ordinance 10-306 was reasonable and necessary to serve an important public purpose. The trial is expected to last the entire week and will involve the calling of witnesses from both the Unions and the City, and may include the calling of Mayor Stephanie Rawlings-Blake (City witness). Closing arguments are anticipated to take place on Friday, February 3, 2012.

The Memorandum of Understanding (MOU), which was ratified by our membership last December 2011, is being finalized to be presented to the City of Baltimore's Board of Estimates for approval.  In the meantime, all police officers, sergeants, and lieutenants may begin to utilize the LTO-Days (Lost Time Off) negotiated by the FOP to make up for the lost wages from last year.  As the vacation book goes around, members may use three (3) LTO-Days between now and June 30, 2012 and the other two (2) LTO-Days may be used between July 1, 2012 and December 31, 2012.

On December 19, 2011, a ratification vote was held at the FOP on the tentative agreement reached by the FOP with the City of Baltimore on a contract for Fiscal Year 2012 (July 1, 2011 - June 30, 2012).

The results of that ratification vote are as follows:

95% of votes cast by Unit I (Police Officers, Police Agents, and Flight Officers) voted in FAVOR of ratification.

96% of votes cast by Unit II (Sergeants and Lieutenants) voted in FAVOR of ratification.

The FOP would like to thank all our members who took the time to vote today and we also want to recognize the FOP Labor Committee who worked to reach an agreement with the City of Baltimore.  Finally, we want to thank Mayor Stephanie Rawlings-Blake and her team for their understanding and professionalism.

The annual FOP3 Holiday Open House will be held this Friday, December 16th from 11:00am until 6:00pm at the FOP Lounge and Hall, located at 3920 Buena Vista Avenue, Baltimore, 21211.  Stop by and enjoy pit beef, ham and turkey, oysters on the half-shell, drinks and Christmas music.  All active and retired FOP members are invited.

Tentative Agreement – Memorandum of Understanding FY 2012

On December 1, 2011, the FOP and City of Baltimore reached a tentative agreement on a one year Memorandum of Understanding subject to ratification by a majority of the votes cast by members in Units I (Police Officers, Police Agents and Flight Officers) & Unit II (Sergeants and Lieutenants). The FOP Labor Committee is recommending ratification of the tentative agreement. Members of the Labor Committee will be out to address roll calls and speak to members within their districts/divisions.

A ratification vote has been scheduled at the FOP Lodge (3920 Buena Vista Avenue, Baltimore, 21211) on Monday, December 19, 2011 from 0600 hours to 1900 hours. Members of the FOP Labor Committee will be available at the Lodge throughout the day of the ratification vote to answer any questions.

Terms of the Tentative Agreement for FY 2012 (July 1, 2011 – June 30, 2012)

***    Each member will receive a salary increase (COLA) of 2.00% effective April 2012.  This increase is not retroactive to July 1, 2011. This delayed pay increase allows our members not to have their wages reduced as was originally sought by the City.

***    Each member shall be credited with four (4) additional paid leave days (PTO-Days) to compensate for the delayed salary increase. These days may be taken after January 1, 2013.

***    Each member shall be credited with five (5) additional paid leave days (LTO-Days) to compensate for the loss of wages enacted by the City during FY 2011.  The first three (3) days can be used between January 1, 2012 – June 30, 2012 and the second two (2) days can be used between July 1, 2012 – December 31, 2012.  Any LTO-Days not used by December 31, 2012 shall be placed in a member’s accumulated leave bank.

***    Each member will receive their scheduled salary step increases.
